SUMMARY: The Food and Drug Administration (FDA) is proposing to amend its regulation on environmental impact considerations to expand existing categorical exclusions to include approvals of humanitarian device exemptions (HDEs) and establishment of special controls as categories of actions that do not individually or cumulatively have a significant effect on the human environment and for which neither an environmental assessment (EA) nor environmental impact statement (EIS) is required. Regulations issued by the Council on Environmental Quality require that all Federal Agencies assess the environmental impact of their major actions and ensure that the interested and affected public is informed of environmental analyses. FDA is taking this action in accordance with the National Environmental Policy Act (NEPA).

"Environmental groups have filed a lawsuit over the National Park Service's plan for allowing snowmobiles in Yellowstone National Park for the next three winters.

The groups claim the government failed to take into account the effect that roads groomed for snow machines have on wildlife, particularly bison, under the temporary plan.

The complaint brought by The Fund for Animals, Bluewater Network and three individuals names as defendants Interior Secretary Gale Norton and National Park Service Director Fran Mainella. The lawsuit was filed last week in U.S. District Court in Washington, D.C., after the Park Service issued a 'finding of no significant impact' for its winter use plans, an attorney said."

"Environmental groups want a federal judge to set aside temporary rules for snowmobiling in Yellowstone National Park because questions about grooming roads in the winter have not been answered.

Their lawsuit was filed in U.S. District Judge Emmet Sullivan's court in Washington, D.C. Sullivan was the judge who last December overturned a Bush administration plan to allow snowmobiling to continue in Yellowstone and Grand Teton national parks.

In his ruling, Sullivan told the Park Service to, among other things, look into the issue of whether scraping the snow off roads has an effect on bison migration in Yellowstone."

DEPARTMENT OF AGRICULTURE (Forest Service) published Notice of Intent to Prepare an Environmental Impact Statement for Black-Tailed Prairie Dog Conservation and Management on the Nebraska National Forest and Associated Units.
SUMMARY: The USDA Forest Service will prepare an Environmental Impact Statement (EIS) for black-tailed prairie dog (Cynomys ludovicianus) conservation and management on the Nebraska National Forest and associated units (NNF). The proposed action will tier to the Final EIS for the 2002 Revised Nebraska National Forest Land and Resource Management Plan (LRMP). The proposed action will utilize and adaptive management strategy to guide implementation of current LRMP direction for black-tailed prairie dogs (hereafter referred to as prairie dog) and additional new direction for reducing unwanted prairie dog colonization on agricultural lands adjoining National Forest System (NFS) lands. The proposed action is consistent with the commitment to be a good neighbor while continuing to conserve prairie dog and associated wildlife as prescribed in the LRMP. This action may require an amendment to the LRMP. The NNF includes the Buffalo Gap and Fort Pierre National Grasslands in South Dakota and the Oglala National Grassland, Nebraska National Forest and Samuel R. McKelvie National Forest in Nebraska.
